Welcome to Above the Clouds (“ATC,” “we,” “us,” or “our”). These Terms and Conditions govern your participation in ATC’s programs, volunteer opportunities, and use of our website and services. By applying to a program, volunteering, donating, or interacting with our services, you agree to these Terms.
If you do not agree with these Terms, please do not submit an application, volunteer, donate, or use our services.
1. Eligibility
Participation in Above the Clouds’ programs and volunteer opportunities is subject to eligibility requirements, including but not limited to:

Meeting age, weight, and health criteria for Dream Flyer flights.

Completing all required waivers, releases, and consent forms.

For volunteers, meeting relevant experience or certification requirements (e.g., pilot credentials, background checks).
We reserve the right to deny participation if eligibility requirements are not met or if safety concerns arise.
2. Assumption of Risk
Participation in aviation activities inherently carries risk. Families and volunteers are required to complete liability waivers acknowledging and accepting these risks before participating.
Above the Clouds and its affiliated volunteers (including pilots) take every reasonable precaution to ensure safety but are not liable for any injuries, accidents, or damages that may occur during participation.
3. Use of Media
With signed consent, Above the Clouds may photograph, film, or record program participants, volunteers, and events for promotional, educational, and fundraising purposes.
Participants and families may opt out by declining to sign the media release form.
4. Code of Conduct
All individuals engaging with Above the Clouds are expected to:

Treat others with respect, kindness, and professionalism.

Follow all instructions provided by ATC staff, volunteers, and airport personnel.

Comply with all applicable laws, safety guidelines, and ATC policies.

Refrain from any behavior that endangers the safety or enjoyment of others.
We reserve the right to remove any participant, volunteer, or guest who fails to adhere to this code of conduct.
5. Donations and Refunds
All donations to Above the Clouds are voluntary and non-refundable unless otherwise required by law. Donation receipts will be provided for tax purposes in accordance with IRS guidelines.
We are a 501(c)(3) nonprofit organization. Donations are tax-deductible to the extent allowed by law.
6. Website Use
When using our website, you agree not to:

Interfere with its operation or security.

Attempt unauthorized access to systems or information.

Post or transmit any unlawful, defamatory, or harmful material.
We reserve the right to restrict or terminate access for any user who violates these Terms.
7. Modifications to Programs or Events
Above the Clouds reserves the right to modify, reschedule, or cancel programs, events, or volunteer opportunities at any time due to weather conditions, safety considerations, operational needs, or other circumstances beyond our control.
We make every effort to provide timely updates and alternative arrangements when possible.
8. Limitation of Liability
To the maximum extent permitted by law, Above the Clouds and its affiliates, officers, directors, volunteers, and agents are not liable for any direct, indirect, incidental, or consequential damages arising out of or related to participation in our programs, volunteer activities, donations, or website use.
9. Changes to These Terms
Above the Clouds may update these Terms from time to time. Updates will be posted on our website with an updated “Effective Date.” Your continued engagement with us after changes are made constitutes acceptance of the new Terms.
